These terms govern your use of the Art Kelen platform, marketplace, editorial, and Circle membership. By creating an account or making a purchase, you agree to these terms. Read them carefully — and write to us if anything is unclear.
01 — Who We Are
Art Kelen is a cultural platform founded by Daffa Konate, based in Paris. We curate and promote contemporary art from across Africa and its diaspora, operate a marketplace for original works, publish editorial, and manage a paid membership programme called the Art Kelen Circle.
02 — Your Account
You may create an account to make purchases, save favourites, manage subscriptions, or — if you are an artist — apply to join the marketplace. You are responsible for keeping your password secure and for all activity under your account. Tell us promptly if you suspect unauthorised access.
03 — Purchases and Payments
All prices are listed in euros and include VAT where applicable. Payment is processed at checkout via Stripe. Title to an artwork transfers when payment is received in full and the work is delivered. Original works are sold "as is" — the artwork you receive is the artwork shown, with the natural variations inherent to handmade work.
04 — Returns
If a work arrives damaged or materially different from its listing, contact us within 14 days of delivery and we will arrange return, replacement, or refund. Otherwise, original works are non-returnable — these are unique pieces and we ask collectors to commit thoughtfully.
05 — Acceptable Use
Do not use the platform to break the law, impersonate others, scrape data without permission, or harass our team or our artists. We reserve the right to suspend any account that does — or that we have good reason to believe will.
06 — Intellectual Property
All artworks remain the intellectual property of their artists. Images on the platform are licensed for display, not for download, redistribution, or training of AI systems. The Art Kelen brand, the platform design, and all editorial content are owned by Art Kelen and may not be reproduced without permission.
07 — Liability
We work hard to keep the platform online and accurate. But we cannot guarantee uninterrupted service, and we are not liable for indirect or consequential losses arising from your use of the platform. Nothing in these terms limits liability that cannot be limited under applicable law.
08 — Governing Law
These terms are governed by French law. Disputes that cannot be resolved between us will be heard by the competent courts of Paris.
